Service Terms and FAA RegulationsThese terms govern the provision of U.S. Agent for Service of Process services for individuals holding Federal Aviation Administration (FAA) certificates while residing outside the United States.
1.
Scope of ServiceOur company ("Agent") provides the applicant ("Client") with official U.S.-based agent representation, in compliance with FAA requirements, including Advisory Circular AC 3-1 and rule 89 FR 81305.
The Agent acts as the designated
U.S. Agent for Service of Process on behalf of the Client.
2.
Agent ResponsibilitiesThe Agent agrees to:
- Provide a valid physical mailing address in the United States for FAA correspondence;
- Receive all official notices, documents, and communications from the FAA on behalf of the Client;
- Promptly notify the Client of any received correspondence via email or other agreed communication channels;
- Upon request, forward scanned copies or physical documents (the latter with shipping costs covered by the Client).
3.
Client ResponsibilitiesThe Client agrees to:
- Provide accurate, complete, and up-to-date personal and certificate information;
- Complete the payment for the service in a timely manner;
- Immediately notify the Agent of any changes to personal, contact, or certification information;
- Understand that failure to maintain a designated U.S. Agent may result in suspension or revocation of their FAA certificate.
- 4. Service Fee and DurationThe service fee is 100 EUR per year.
- The service is activated upon receipt of full payment.
- The service remains valid for 12 months from the activation date.
- The Client will receive a renewal reminder at least 30 days before the service expiration.
5.
Limitation of LiabilityThe Agent shall not be held responsible for:
- Delays or non-delivery of FAA notices due to outdated or incorrect Client contact information;
- Any loss, delay, or misdelivery caused by third-party carriers (postal or courier services);
- Any FAA regulatory compliance issues arising from the Client’s personal actions or omissions.
6.
Early TerminationThe service may be terminated early in the following cases:
- Breach of these service terms by the Client;
- Discovery of intentional submission of false or misleading information by the Client;
- Non-payment for service renewal within the required timeframe.
7.
JurisdictionAny disputes arising from or related to this service shall be governed by the laws of the United States, under the jurisdiction of the state where the Agent is registered.
